These terms cover your use of LevelWage at levelwage.com and app.levelwage.com ("LevelWage", "we", "us"). By creating an account or using the service you agree to them. If you use LevelWage for a company, you agree on its behalf.
1. What LevelWage does
LevelWage prepares certified payroll reports (such as the WH-347 and state payroll files) from payroll data you provide, checks them against the wage rates you select, and delivers them to you for review. Reports are prepared for your review. You decide whether to sign and submit them.
2. What LevelWage is not
- We are not a payroll provider. We do not pay your workers, withhold or file taxes, or move money.
- We are not a law firm and do not give legal advice. Our guides explain rules in plain words; they are not legal advice.
- We are not a government agency, and we are not certified, approved or endorsed by the Department of Labor or any state agency.
- We never sign a Statement of Compliance or submit a payroll in your name. The certifying official you name signs.
3. Your responsibilities
- Give us accurate payroll data, select the correct wage determination and classifications for your contract, and confirm each worker's details.
- Review every report before you sign or submit it. You are responsible for what you certify.
- Pay your workers what the law and your contract require. If our checks find underpayment, we will not deliver the report until it is corrected.
- Have the right to share the payroll data you upload with us.
4. Plans and payment
Prices are on the pricing page. One-time plans (One report, Project Pass, 30-Day Pass) do not renew. Unlimited renews monthly or yearly until you cancel, which you can do at any time in one click; you keep access to the end of the period you paid for. Payments are processed by our payment provider.
5. The fix-it promise
If a prime contractor or agency returns a report because of a math or form error on our side, we will fix it within one business day and refund the fee for that week's report (or extend your Project Pass by one month). Errors that come from data you gave us, from your choice of wage determination or classification, or from a rule we told you we did not check, are not covered. This promise is your remedy for our errors.
6. Delivery time
We aim to deliver within 8 working hours (Monday to Friday, 7am to 7pm US Eastern). If we miss that on a report that was not waiting on information from you, that report is free; we add the credit automatically.
7. Reviews
During our founding reviewer program we refund 50% of a first purchase (up to $75 per company) for a genuine review of any rating. We may publish reviews only with your consent, and we label reviews that received a refund.
8. Your data
You own the payroll data you upload and the reports we make for you. We use it to provide the service as described in our privacy policy and security page.
9. Limits
The service is provided "as is". To the extent the law allows, our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses, including withheld contract payments, penalties or lost profits.
10. Ending your account
You can stop using LevelWage at any time and ask us to delete your data. We may suspend accounts used for fraud or to misrepresent payrolls.
11. Changes
We may update these terms. If a change is material, we will email account owners before it takes effect.
