Two kinds of prevailing wage in Illinois

Federal (Davis-Bacon). Construction contracts over $2,000 paid for or assisted with federal money pay the rates in a federal wage determination for the county and construction type. Those rates are on this site, county by county, and the weekly certified payroll is usually the WH-347.

State (Illinois law). State and local public works pay the state's rates under Prevailing Wage Act, 820 ILCS 130 [820 ILCS 130]. The agency is the Illinois Department of Labor (IDOL).

A project covered only by Davis-Bacon is not filed in the Illinois portal; you send the federal weekly certified payroll to your prime or agency. When a project is covered by both laws, you file both.

Which projects are covered

  • Public works means all fixed works constructed or demolished by any public body, or paid for wholly or in part out of public funds, including projects financed by bonds, grants and loans, and maintenance work [820 ILCS 130/2].
  • IDOL notes a project does not have to be for public use to be covered [IDOL FAQ].

How state rates are set

IDOL sets rates by county and publishes them each year by July 15 [820 ILCS 130/9]. If IDOL revises a rate, the revised rate applies to contracts already underway [IDOL FAQ]. Current rates: IDOL current prevailing rates.

Overtime

Contractors pay the overtime and holiday rates on IDOL's schedule for each classification [820 ILCS 130/3].

What is the difference between Illinois prevailing wage and Davis-Bacon?
Davis-Bacon is federal: it covers construction paid for or assisted with federal money, with rates from wage determinations on SAM.gov. Illinois's own law covers state and local public works, with rates set by the state. A project covered only by Davis-Bacon is not filed in the Illinois portal; you send the federal weekly certified payroll to your prime or agency.
